Don't know about the laws in the US, but it would have been illegal in some parts of Australia (e.g. NSW has very strong anti-discrimination laws, see http://www.actsofpassion.nsw.gov.au/).

There isn't a federal anti-discrimination law on grounds of sexuality (although this chart (http://www.lambdalegal.org/cgi-bin/iowa/documents/record?record=217) seems to say that matters of public (read: government) employment are covered by federal civil rights laws), so it's up to individual states to create such laws. California has such a law (http://www.lambdalegal.org/cgi-bin/iowa/states/record?record=5), which covers "public accomidations" but I'm not sure a restaurant counts as such. Last I knew lots of commerical establishments had "we can deny service to anyone we want" rules, but I'm not sure how legal those are.

Yes, a restaurant is a "public accommodation". (Unless it's a private club, like the Elks or something, where you have to be a member to join. That's the distinction. If they solicit custom from the public, they are a public accommodation.) IANAL, especially not in California, but unless the restaurant can plausibly claim that they would have treated a mixed-sex couple behaving identically the same way, that was probably illegal in California.

You know, by and large, I'm opposed to widespread carrying of handguns in densely-populated cities, but I can see arguments the other way.

Given that information, I left a comment at the post that wispfox linked to with a link to the local ACLU of the poster, so they can get in touch with the ACLU if they feel like bringing the case to court. Which they might not (and with good reason), but what the hell, tossing out the info doesn't hurt. . .

And prizmdonna (a personal, off-LJ friend of mine) states that she's been there with her male partner, behaved in at least as cuddly a fashion, if not more, and been treated well.
